New York AED Laws

New York

Primary statute: Public Health Law § 3000-b; Education Law § 917 (schools); GBL § 627-a (health clubs)

Good Samaritan Protection Civil immunity for users, acquirers, trainers, and authorizing physicians acting in good faith, absent gross negligence.
Medical Direction Required. Programs must operate under a written Collaborative Agreement with a licensed physician (the emergency healthcare provider).
Training Required. Expected users must be trained in CPR/AED use.
Maintenance & Testing Required per manufacturer guidelines.
EMS Notification Required. AED locations must be registered with the regional EMS council.
Placement Mandates Required in K-12 public schools, health clubs with 500+ members, and certain places of public assembly.

 

Practical note: New York's Collaborative Agreement is unique — it formalizes the relationship between the AED program and physician medical director. Programs cannot legally place an AED into service without one.
